Our Terms & Conditions Sale for Consumers

Parties:

  1. The parties to this contract are:
    • The Seller: Wildman Brewing Company Limited, a company registered in England and Wales. Our company number is 11764293, Our VAT number is 499 0584 35 and our registered office is at 5 Lords Drive, St George’s, Telford TF2 9UE (hereafter referred to as We/ Us/ Our).
    • The Buyer an individual buying Our products for personal consumption or to provide to another individual as a gift (hereafter referred to as You/Your).

Purchase via our Website:

  1. The products We supply are natural; they are usually Fairtrade and organic. We hand-roast. They are also seasonal. We cannot guarantee colour or taste from batch-to-batch or even that we can continue to supply one particular coffee or bean throughout the year. Where We are unable to supply a particular bean We will, at Your request, recommend an alternative.
  2. The price of the product (which includes VAT) is the price indicated on the order pages when You place your order. The total price you pay will include packing and postage to the address that You provide as part of Your order. Once Your order is complete We will provide an email breaking down the cost of the order between items purchased, postage and VAT (if applicable).
  3. We will not charge Your credit or debit card until We despatch the goods to You.
  4. As set out in Clause 7 b) of Our Website terms of Use, Our website is designed for UK residents. If You are based outside the UK We reserve the right to decline to supply.

Processing Your Order:

  1. The order is placed by You when you select the product, type (e.g. bean, fine grind or course grind) and quantity and your payment is accepted by our payment processors.
  2. We try to ensure that we only advertise goods that we have in stock on our website. If, for any reason, the goods are not in stock We will notify You within 24-hours of Your order and offer an alternative or a refund.
  3. Time of delivery is not of the essence although We always aim to post goods to customers’ within 7-days of completion of the contract

Making Changes:

  1. If You wish to make a change to Your order please contact Us. Providing Your existing order has not been shipped We will cancel Your order so that You can substitute a new order.
  2. If the existing goods have been shipped and you no longer require them then, providing they are unused, they may be returned to Us at Your cost.

Our Products:

  1. The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images.
  2. The coffee we provide is an entirely natural product that is hand-roasted using a range of different coffee roasting machines that we own. The product may therefore have minor batch-to-batch variations depending upon the bean, the roaster used and who roasted it.
  3. Although we have made every effort to be as accurate as possible, because our products are hand roasted and packed, all sizes, weights, capacities, dimensions and measurements indicated on our website have a +/- 8% tolerance
  4. The packaging of the product may vary from that shown on images on our website.
  5. We may make minor changes to Our products:
    • to reflect changes in relevant laws and regulatory requirements; and
    • to implement minor technical adjustments and improvements.

Product Delivery:

  1. As we also manufacture alcoholic products we are licenced by the local authority and must abide by the terms of that licence. Our licence does not allow customers’ to come to our premises and collect the good they have ordered. Regrettably, even if You are local the products You have ordered will have to be posted.
  2. The cost of delivery will be included in Your final order value.
  3. All goods will be sent tracked, but not signed for.
  4. We may use Royal Mail, Evri, DHL, Yodel or any other carrier We choose providing they can provide a 48-hour delivery tracked service.
  5. Once We have despatched the item, We are not responsible for delays in delivery caused by the carrier.

Delivery:

  1. The goods are your responsibility from the time and place of delivery. Although the delivery service may be tracked and We can, at Your request, supply the tracking number We cannot be held responsible for non-receipt if the carrier is able to provide evidence of delivery.
  2. If goods have not been delivered within 14-days of Your order, please contact Us using so We can investigate with the carrier and, if necessary, arrange to send a further consignment or arrange a refund.

Product Faults:

  1. If You believe the product as delivered is faulty or has been misdescribed, please contact us as soon as reasonably practicable on 07801 938546 or at advising us of either the order number of the product we have supplied or the product name and date roasted (both product name and date roasted are on the bag).
    • If You believe the product has been misdescribed, please explain to Us why You believe it misdescribed (e.g. you ordered medium roast and we have delivered a dark roast)
    • If You believe the product is defective, please explain to Us why You believe it to be defective.
    • Once We know what is wrong then We will do our best to agree a solution to the problem with You.
    • We may request that You return the defective or misdescribed product to Us. If We ask You to return them, then We will either send You a return postage label or refund the return costs when we issue the refund for the goods themselves.
  2. Nothing in this contract is designed to exclude or limit Your statutory rights under the Sale of Goods Act 1979, The Consumer Rights Act 2015 or the Consumer Protection Act 1987.

Distance Sales:

  1. This contract is governed by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If You want to return the item because You have changed Your mind then You have 14 days from the date of purchase to advise Us that You wish to return the goods. You then have 14-days from the date You have told Us that You want to cancel to return the goods to Us.
    • If you:
      • exercise this right, the goods must be unopened. We are not required to provide a refund if You have opened the item as it was sealed for hygiene reasons (Please note, that, if the goods are defective, you have rights under Clauses 21 and 22).
      • return the goods and request a refund, We will include the cost You paid us to post the item to You. We are not responsible for Your costs of postage back to Us because You have changed Your mind.

    • Goods must be posted back to Lizard Lane Coffee at Unit 11, Lizard Lane Trading Estate, Lizard Lane, Shifnal, Shropshire, TF11 8QE.
    • Once We have the goods back We will make the refund as soon as possible, after we have examined them.
    • If the packaging is damaged beyond that which would have occurred in normal shipment or in handing in a shop then, even if unopened, we are not obliged to offer a full refund.
    • If You are not within the 14-day period specified under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 then Your rights to a refund is limited to those rights within clauses 21 and 22.

Use of your Personal Information:

General Terms:

  1. If We sell the business the benefit of this agreement will transfer to them. We will always tell you in writing if this happens and We will ensure that the transfer will not affect Your rights under the contract.
  2. No other third-party has any rights under this contract. The application of the Contracts (Rights of Third Parties) Act 1999 is excluded.
  3. If a court determines that any clause of this contract is illegal, that finding will have no effect on any other clause or condition and the rest of the contract will remain in full force and effect.
  4. If We believe that You have breached any term of this contract then any delay on Our part in enforcing it does not mean that We have acquiesced to the breach. We reserve the right to enforce at a later date of Our choosing.

Law Applicable:

  1. This contract is governed by the laws of the United Kingdom which apply to that part of the United Kingdom in in which You live.
